Terms of service

A draft written by the team, not by a lawyer, and to be reviewed before Aux0 takes a paying customer. We have tried to make it say what we actually mean.

Who we are, and what Aux0 provides

Aux0 is a product of Exa Labs LLC, and these terms are an agreement between you and Exa Labs LLC.

An API that connects accounts your users hold with third-party providers, and reads and writes on those accounts on their behalf. We provide the service; we do not provide the accounts, and we do not control the providers.

The provider risk, stated plainly

Every account Aux0 connects stays subject to its own provider's terms, and a provider can suspend, rate-limit or close an account for reasons that have nothing to do with us. We are not affiliated with, endorsed by or sponsored by any of the providers we connect.

We reduce what can be reduced: pacing every send inside the provider's own quotas, holding work rather than retrying into a limit, and stopping instead of retrying when a provider pushes back. We cannot eliminate provider-side risk, and we do not promise to.

Your responsibilities

• Get your users' informed consent before connecting their accounts, and make clear what your product will do with them.
• Comply with the law that applies to you, including on marketing consent, data protection and the recording of communications.
• Do not use Aux0 for unsolicited bulk messaging, harassment, impersonation, or anything the provider's own terms forbid.
• Keep your API keys secret, and revoke one you think is exposed.

What we may suspend

We may suspend an account or a project that is being used for bulk unsolicited messaging, harassment or fraud, or whose traffic puts other customers' accounts at risk with a provider. Where we can, we will tell you first and give you a chance to fix it.

Payment

Plans bill monthly or annually in advance; account overages bill monthly in arrears. Cancel at any time and the service runs to the end of the period you paid for. We do not refund part-periods, but if you believe a bill is wrong, write to hello@aux0.com and we will look at it.

Availability

Growth carries a 99.9% monthly uptime commitment and Scale 99.95%, each with service credits. Free and Starter carry none. Provider outages and provider-side restrictions are outside those commitments, because they are outside our control.

Your data

You own your data and your end users'. We hold it to provide the service, as described in our privacy policy. If you leave, you can export it, and we delete it on the schedule in that policy.

Liability

To the extent the law allows, our liability is limited to what you paid us in the twelve months before the claim. We are not liable for a provider restricting one of your users' accounts, for lost profit, or for lost business opportunity.

Changes

If these terms change materially, we will email you 30 days before the change takes effect.
